NEET PG 2023: Supreme Court postpones NEET PG Examination postponed hearing to Monday.

Hearing has been postponed to Monday by the Supreme Court India. The petition to postpone the examination was heard by bench comprising Justices Ravindra Bhat and Dipankar Datta.

The petition has been filed by the Medical students appearing for NEET PG 2023 exam to postpone the examination that is scheduled to be conducted on March 5, 2023 and also to extend the internship cutoff date. Some of the students who are doing their internship have demanded postponement of the examination saying they are finding it difficult to get time to prepare for the exam.

Petition Filed By Doctors in Supreme Court of India

The petitioners, who are doctors seeking to appear in NEET-PG,  pointed out that the NBE initially fixed the cut-off date for internship completion as March 31, 2023, when it first issued the notification for NEET-PG 2023 on January 7, 2023. Later, on January 13, the cut-off date was extended to June 30. Again, on February 7, the cut-off date was further extended to August 11, 2023. The petitioners contend that although the cut-off date has been extended, since the exams are to be held on the initially announced date, the newly eligible candidates do not get adequate time to prepare.

NEET PG 2023 examination will be conducted for admission to various MD/MS admission and PG Diploma admission. The admit card will be issued on February 27 and result will be declared on March 31, 2023

Additional Solicitor General Aishwarya Bhat is representing NBE. She says that 2 ,090,29 candidates have applied for NEET PG Exams 2023.

 Telangana High Court have disposed off the plea, along with Madhya Pradesh High Court have also disposed off the matter saying those who are there they can participate.

Candidates in possession of MBBS degree or provisional MBBS pass certificate and have completed one year of internship or are likely to complete the internship on or before March 31, 2023, may appear for NEET PG examination. Later, the internship cut off date was extended till June 30, 2023.

Indian Medical Association, student union bodies, prospective candidates and several state authorities had then urged the Union health ministry to extend the eligibility date to June 30, 2023.

The petitioners allege that the National Board of Examination issued the notice without checking with all the State Medical Councils regarding one of the most important aspects of eligibility. It is argued that the eligibility criteria been modified twice by NBE, clearly reflects the oversight and mismanagement on its part of not consulting the state medical bodies in advance, thereby giving no time to the candidates to prepare.

“If NBE had directly released the cut-off date when the information bulletin was released in January 2023, there would have been no issues. How can a candidate who got permission to apply barely 25 days prior to the examination be equal to the candidates who had permission to apply 60 days prior to the examination”, the petitioners argued.

During the hearing on Friday, the bench observed that postponement of the exam will cause to hardship to several students, considering the fact that over 2 lakh candidates have already registered for NEET-PG 2023. The bench also observed that the petitioners were not otherwise eligible to appear for the exam on March 5, 2023, and became eligible only because of the relaxation granted by the NBE. Therefore, can the petitioners now seek to defer the exams, asked the bench.

While speaking at a function held in Ganga Ram hospital, New Delhi, yesterday, Chief Justice of India DY Chandrachud observed :

“Several cases challenging National Medical Commission’s decisions or cases relating to NEET have found their way to my bench at the Supreme Court. Often, courts cannot enter policy domain and it is the duty of the state to listen to the representations made by the students. However, whenever injustice is done, it becomes our bounden duty to intervene. The sheer volume of litigation of NEET cases is indicative of the hopes and aspirations of millions of students. It is proof that medicine is one of the most sought-after professions in India. Yet, the litigation is also symbolic of the need for reforms in medical education in India”
